Retaliation in district Court

District Court

Brian appealed the small claims award by claiming out of all of the notices he got for court hearings, the notice for the final hearing was the one that somehow got missed.


He then responded to it by filing a suit against me.

Irreparably Harmed

He started off his suit against me by claiming he was "irreparably harmed" because I was somehow able to force him to take cash as part of his retainer. The "evidence" he submitted didn't support that.

He said it was my fault he was on probation

One of the justifications Brian tried to use was he felt it was my fault he was on probation - despite the evidence of several others who were harmed by him at the same time.

He admitted to an ethics violation

I hired him because I thought he represented another tenant in my building. Had he been truthful with me about what he did in that case, I would have never hired him. He told the court that he told me what he did to the other tenant - which would have been an ethics violation if he had actually done it - so I knew what he was planning to do.


Court records for that other case show he didn't use housing law or the great deal of evidence the tenant had to benefit the tenant. If he had been truthful with me about that, I never would have hired him.

Phone calls

He told the court that I had called his office multiple times to harass his staff. He never provided any evidence of this, because he couldn't as it never happened.

Telling other people

He told the court that I harmed him because he had to tell potential new clients he was on probation. It wasn't my fault he had to do that. It was one of the conditions of his probation that he agreed to.


However, OLPR never required him to show evidence that he was complying with this condition of his probation and OLPR never told him to stop blaming me, either.
